K3 Spousal Requirements
For those who are undecided in which route to
take, the k1 or the k3 visa? We have something for you to consider before making
a haste decision. Their are many couples who have chosen to marry in the
Philippines without fully understanding what lye ahead of them.
It is not our job to scare nor force you to go
the k1 visa route. Many now married couples are forced with little choice but to
go the k3 visa route. For all of you in this position we have put together a
list of things you need to do in order to satisfie USCIS.
The rules are basically the same as everything
that we have listed above but with a few more twists and turns added to it.
Married Couples must provide evidence of a bona fide marriage.
A marriage certificate from the Philippines is not enough evidence to prove that your marriage is bona fide. Throughout the years there has been many so called sham or fixed marriages that pretty much led to bringing someone to the USA solely for that purpose.
USCIS makes it very tough on couples who are sincerely married and have a loving relationship. In order to properly meet the requirements, the couple must demonstrate that they are a working, functioning husband and wife.

Before coming to the Philippines to get married you need to know what is expected of you.
► Attend the US Embassy to prove that your free to marry.
► Gather marriage license and allow up to 10 days waiting time.
► Have your wedding then, ad another 24 hours for marriage certificate to become certified.
► Go with your new wife together to open a joint bank account.
► Make some purchases together with your wife that require payments.
► Get your name together with your wife's on all her bills.

How to Prove to USCIS that you have a Bona-Fide K 3 Marriage
All of the above items are a must and for the average person this may require up to 21 days or more. The USCIS wants the couple to establish a bona fide marriage and the best way to do this is by mingling your bills together.
Then the US sponsor returns back to their home in the states to continue all of the above items mentioned for K1 Fiancee relationships
even if applying for K3. So that you are able to have a case while filing for your K3 spousal visa. |
